Post-Conviction Services - Expungements / Reduction of Charges
Our firm offers post-conviction relief services, including early termination of probation, expungement and reduction of charges (when available) from felonies to misdemeanors and misdemeanors to infractions. Early termination of probation or modification of probation under California Penal Code section 1203.3, expungement of convictions under California Penal Code section 1203.4, and reduction of charges under California Penal Code section 17(b), can not only have beneficial effects for employment and reputation, but can make the absolute difference between success and failure in a license application or license defense case.
We represent individuals in all major counties in California to seek post-conviction relief. Most courts will charge a $120.00 fee for an expungement (1203.4) motion. Fees are usually not charged for early termination of probation, modification of probation, or reducing charges.
We also can assist with correction of erroneous data on rap sheets (California criminal record reports) and sealing of juvenile records.
The process for post-conviction relief involves the following:
1) Obtaining official records to determine what relief is available and to determine sufficient information to bring a motion. This can include getting records from the courthouse or ordering a criminal record.
2) Determining the proper motion or motions to bring to best obtain the objectives of the client. We always give clients frank and fair advice on what the relief sought may or may not accomplish for the client.
3) File the motion in the court and serve the prosecutor. Some motions may require an appearance in court.
4) Follow up with the court until the matter is concluded, and obtain copies of the court's order(s) for the client to use for employment, applications or in license defense proceedings.
